These terms and conditions describe the rules and regulations for using the Anne . L Photographe Immobilier website, located at https://www.annelphotoimmo.com/.

By accessing this website, we assume that you accept these terms and conditions. Do not continue to use Anne . L Photographe Immobilier if you do not agree to all of the terms and conditions stated on this page.

The general terms and conditions of sale (hereinafter referred to as "GTCS") create a legal agreement and apply to all orders for services and products concluded between the Customer and Anne.L Photographe Immobilier. Any booking of a session or order for products implies full acceptance of these GSC, unless special conditions have been agreed in writing between the photographer and the customer.

Prices
Prices are quoted in euros, exclusive of VAT (article 293B of the French General Tax Code), and are applicable at the time of booking a session or ordering additional products. Prices are subject to change at any time without notice. The valid price is the one indicated on your contract and/or order form.

 

Service
The service covers not only the time devoted to the shooting required to create the images, but also the written and oral exchanges prior to the session, and the work carried out on the photos selected by the customer: exposure, contrast, colorimetry.
The photographer is not bound by an obligation of result. He will do his utmost to provide quality images, as stipulated in the order. Post-processing, in the same way as shooting, is the photographer's responsibility and an integral part of his or her work and artistic style. The photographer alone decides on the post-processing to be applied to the negatives. No "raw" digital file in RAW, DNG or other format may be requested by the customer.
The service does not include any physical/printed photographs. Photos in digital format will only be delivered via a gallery dedicated to the customer with the entire selection via a platform dedicated to this purpose.
Depending on the package chosen, the customer has a fixed number of digital photos included in the service. Under no circumstances will the photographer deliver all the photos taken. If the customer wishes to acquire additional photos, a fixed price will be offered in addition to the initial service.

Service modification
Any request for modification of a service requested by a customer can only be taken into account if the request is sent by e-mail or SMS to the photographer at least 7 days before the planned date of the service. In accordance with the legal provisions in force, the customer has a 14-day cooling-off period from the conclusion of the contract. Any request for withdrawal made within this period will result in reimbursement of the deposit. Unless the service has already been provided in full or in part.
In the event of cancellation of a reservation for a photographic service that has become definitive, we remind you that, in accordance with legal provisions, the deposit will not be reimbursed, except in cases of force majeure for the customer. Reimbursement in the form of a credit note is possible.

Performance and delays
The service is provided at the location agreed at the time of booking. The time set for the service is imperative, and any delay on the part of customers may be charged against the time previously agreed for the session. If the session is more than 30 minutes late, it will be cancelled and the deposit will not be refunded. In the event of a delay on the part of either the photographer or the client, the latter will make every effort to inform themselves of any delays or incidents delaying the start of the session. The duration of the session is agreed on the https://www.annelphotoimmo.com/ website and remains indicative for the customer. The session ends when only the photographer considers that he has enough photographs to process the order.

Customer obligations
The Customer acknowledges that he/she is aware of the characteristics and constraints, particularly technical, of all Services.
These constraints, specified in the Order Confirmation e-mail, are :
- The property to be photographed must be made available and freely accessible at the times agreed with the Customer or his representative (owner of the property).
- The property to be photographed must be clean and tidy. The photographer cannot be held responsible for the consequences of photographs distorted by poor preparation of the property.
The Customer is solely responsible for his or her use of the Services.

In the event that the property to be photographed does not comply with the above conditions, Anne . L Photographe Immobilier reserves the right to cancel the appointment (and keep the deposit paid as compensation), schedule a new shoot (and demand a new deposit) or apply an extra charge of €50 per room on the invoice for tidying / decluttering.

Delivery of photographs
Provision of Photographs
The Photographs resulting from the Shooting are made available to the Customer via a download link sent by email, within a maximum of forty-eight (48) working hours from the completion of the Shooting (except in cases of force majeure).
Photographs are delivered in JPEG format with a minimum resolution of 300 dpi.
No Photographs will be delivered on paper, CD ROM or USB key.
The Photographs are available, i.e. accessible and freely downloadable by the Customer via the link sent by email for a period of 7 days.
The Customer thus undertakes to take the necessary steps to back up, by his/her own means, the Photographs purchased during the period in which they are made available on the download platform.
If the customer wishes to access the photographs again, he/she must pay a fixed fee of €20 (excl. VAT) per shoot.

Delay in delivery
In the event of failure to deliver within the above-mentioned time limit, the photographer undertakes to reimburse the Customer 10% of the amount of the package ordered, provided that the Customer submits a request by e-mail to the above-mentioned address no later than four (4) days after the Shooting has taken place.
The Customer's request for reimbursement must include the following information:
- contact details,
- the date and number of the Order,
- the reason for the refund request.

Force Majeure/Deteriorating weather conditions:
In the event of force majeure or adverse weather conditions, such as thunderstorms, storms, heavy rain, etc. (non-exhaustive list). The Photographer cannot be held responsible for the non-execution, partial execution, or inferior quality of the services initially provided for in the order. When the subject of the order permits, after discussion with the customer and agreement between the parties, the session will be postponed to a later date.
The photographer cannot be held responsible for such cancellations, nor can they give rise to the payment of damages on any grounds whatsoever.
The photographer undertakes to reschedule the photographic service. 
The photographer or the customer undertakes to inform the other party as soon as possible by telephone or e-mail. By mutual agreement, a new date will be scheduled, at no extra cost for an identical service.

Terms of payment

Deposit
A deposit of 50% of the service is payable on receipt of the quotation.
Payment of a deposit constitutes a firm commitment on the part of the customer and implies full acceptance of these GTC. 
The reservation is only definitive on receipt of this payment. If payment is not received within 7 days of the photographer agreeing to the date and time agreed with the customer, the booking will be cancelled without notice and without the customer being entitled to claim any compensation. No price reduction will be granted for cash payment. 
In accordance with the law, the customer has a cooling-off period of 14 working days from the day after the session has been booked. After this period, no sums already paid will be reimbursed in the event of cancellation on the part of the customer, whatever the reason.

Balance
The balance must be paid by the customer on the day of the session. Any charges relating to payment made in a foreign currency are to be borne entirely by the customer. No discount will be granted for cash or advance payment. Non-payment of the balance will result in cancellation of delivery of the photos, without reimbursement of the deposit received. Final delivery of photos will only take place once the order has been paid in full. 
In the event of late payment, interest will be charged at 3 times the legal rate, in accordance with law no. 2008-776 of August 4, 2008.

Travel expenses
Travel expenses are included up to a maximum of 40km from the photographer's home (23, rue Rambuteau - IGNY 91430). 
Beyond this limit, transport costs corresponding to 0.50€ per kilometer travelled, and any other costs (tolls, etc.) will be charged to the customer. In the event of restrictions on the use of the photographer's vehicle imposed by law ("crit'air" restriction, odd/even day, etc.), the photographer reserves the right to invoice the customer for any penalties/fines incurred in order to ensure the smooth running of the service (charges applied on an actual basis).

This agreement is effective as of the date hereof.

Modification of the GCS
The Photographer reserves the right to modify, at any time and without prior notice, the present General Terms and Conditions of Sale in order to adapt them to the changes necessary to satisfy his activity and the relationship with the Customer.

Applicable law
All services provided by Le Photographe are subject to French law. For all disputes relating to the application of these GCS or services provided by Le Photographe, the Commercial Court of EVRY, on which the service provider's registered office depends, shall have sole jurisdiction. In the event of a dispute relating to the interpretation or execution of the service, the parties shall seek an amicable agreement before taking any legal action.
